Atiku Appeals Tribunal Judgment At Supreme Court

THE 2023 Presidential Candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has headed for the Supreme Court in an appeal against the judgment of the Presidential Election Petition Tribunal (PEPT) which upheld the declaration of President Bola Tinubu as winner of the February 2023 Presidential election.

The appeal was filed on Tuesday, AfriqueCan gathered.

Recall that a 5-man panel of the Presidential Election Petition Court led by Haruna Tsammani, dismissed the petition of Atiku challenging the victory of President Tinubu at the polls.

Atiku’s legal team, led by Chris Uche (SAN), filed a notice of appeal against the PEPT judgment bordering on 35 grounds.

The Counsel to Atiku described the tribunal’s judgment as a “grave error and miscarriage of justice.”

Atiku’s legal team asked the Supreme Court to overrule the tribunal’s judgment as it was not in consonance with the grounds of their client’s petition.

Atiku prayed the apex court to rule on Tinubu’s inability to amass a majority of lawful votes cast during the February 25, 2023 presidential election.

Atiku’s legal team also argued that INEC conducted the election based on complete misrepresentation that runs contrary to the guidelines of the Electoral Act 2022, based on the “doctrine of legitimate expectation.”

It therefore argued that, by not nullifying the Presidential election, the tribunal’s judgment did not represent the full picture of the law.
