REPS: Court Sacks Elumelu, Declares LP’s Okolie Winner

THE Court of Appeal sitting in Abuja has sacked Ndudi Elumelu of the People’s Democratic Party (Party) in the House of Representatives election in Aniocha/Oshimili Federal Constituency of Delta State.

The Appeal Court, on Thursday, has now declared Ngozi Okolie of the Labour Party (LP) as winner of the election.

The National and State Houses of Assembly Election Tribunal in Asaba had, on July 24, declared Ndudi Elumelu of the Peoples Democratic Party (PDP) as winner of the last election for Aniocha/Oshimili Federal Constituency of Delta State.

The judgment of the tribunal has now been reversed by the Appellate Court after it dismissed Elumelu’s petition to the tribunal.

Counsel to the Labour Party Candidate, Mahmud Magaji, had argued that his client, Okolie was nominated by the party and duly bore its flag at the election.

He argued that his client had resigned his appointment as a Senior Special Assistant to Delta State Government in accordance with the guidelines of the constitution.

The Appellate Court agreed with the Counsel to the LP Candidate and subsequently threw out Elumelu’s petition in it’s judgment.
